Only two weeks after announcing its proclamation to give the appearance of securing the border that it willfully opened, Democrats are proposing new, unconstitutional amnesty programs. As Stuart Varney explained on his FOX Business page, “An estimated 1.1 million illegals would be allowed to stay if they've been here for 10 years and are married to U.S.
citizens. They would get work permits and could not be deported. It would be the mother of all amnesty programs, it is vote buying. 7.6 million migrants have come here since Biden took office. There are another 1.9 million known ‘gotaways’.”
The Biden Administration is undermining the rule of law at every turn. First, they opened our borders to millions of illegal aliens, including criminals, gang members, and terrorists. Now, they are unlawfully granting amnesty to illegal aliens who have successfully broken our laws for a period of years. Americans are fed up with the lawlessness.
First, according to a White House announcement, Democrat President Biden intends to give permanent residence and a path to citizenship to hundreds of thousands of illegal alien spouses of U.S. citizens and their noncitizen, minor children.
Second, President Biden intends to give employment-based visas, which include a path to citizenship, to DACA recipients and other illegal aliens who graduated from U.S. colleges.
Among the largest and most insidious aspects of the Democrats’ unconstitutional amnesty plan is amnesty for illegal alien spouses and children. The Democrats’ plan would:
Establishes a new amnesty program (parole-in-place) for certain illegal alien spouses if they—
○ Have been illegally present in the U.S. for over 10 years; and
○ Were married to a U.S. citizen as of June 17, 2024.
Allows eligible aliens to receive a 3-year work permit and green card eligibility (with a path to citizenship) without following the current process established by Congress.
The eligible population (according to DHS) is 500,000 illegal alien spouses and 50,000 children. This is in addition to the more than 1 million already unlawfully granted parole by the Biden Administration.
To reward radical illegal alien activists Democrats are also planning to offer amnesty to illegal alien college graduates – many of whom were granted special privileges, such as in-state tuition, in order to give them an advantage over citizen college applicants.
The Democrats new plan establishes a program to grant employment-based visas to college graduate DACA recipients and other illegal alien graduates if they have an offer of employment in their area of study.
How can we fight back?
Our friends at the Immigration Accountability Project suggest Congress must respond and stop these programs or risk their expansion. Congress controls immigration policy and cannot allow Democrats to continue to abuse parole or other means to invent its own immigration system. It is incumbent on Congress to use its constitutional authority to defund these amnesties and to challenge them in court.
“Today's action – designed to shore-up the president's far-left political base – includes tangible and enduring benefits for illegal aliens. It is not simply a decision to defer removal proceedings. It is an immigration benefits program that gives illegal aliens a reprieve from deportation and allows them to apply for work authorization, Social Security numbers, Obamacare and green cards. It also makes them "qualified aliens" under federal law, which means that in a few short years they will be eligible for Medicaid, food stamps and a plethora of federal means-tested benefits. To make matters worse, by granting these aliens parole-in-place, they will jump to the front of the line, ahead of aliens legally applying for green cards, said Dan Stein, president of the Federation for American Immigration Reform (FAIR).
“The political motivation the White House's recent antics is not speculative. The president spelled it out clearly at the time he issued his loophole-ridden executive order stating, 'For those who say the steps I've taken are too strict, I say to you … be patient. In the weeks ahead — and I mean the weeks ahead — I will speak to how we can make our immigration system more fair and more just.' Rewarding illegal immigration with amnesty is neither fair nor just, nor does he have any constitutional authority to do so," Stein continued.
"Given the magnitude of the illegal immigration crisis and the administration's repeated and flagrant abuse of our immigration laws to allow illegal aliens to enter the country, it is imperative that Congress take decisive action to halt today's unlawful and politically-driven order from taking effect," concluded Stein.
The Federal Register has not yet published the full details, including which criminal offenses (other than illegal entry or visa overstay) will be waived for amnesty applicants.
